In the Cleveland mesothelioma case, Panza vs. Kelsey Hayes, John Panza obtained a verdict of $27.5 million. The law firm of Waters & Kraus, LLP served as council for John Panza, a 40 year old college professor who went through an extra pleural pneumonectomy (EPP). His exposure was from his father who was a bystander at a facility that worked on friction materials and brought home fibers on his clothes.
This was a true victory for both the plaintive, John Panza, as well as, in the legal fight against companies that need to be held responsible for the health damages that have affected families like John’s and that result in mesothelioma cancer years later.
Panza’s exposure was secondary meaning that he was not directly in the environment where there was asbestos. Like many, the secondary exposure came into the home from work clothes of an employee, in this case John’s father. The company that is responsible for the direct exposure should be held accountable for the secondary asbestos exposure that causes mesothelioma.
